We have developed significant expertise in assisting clients with compensation claims arising from the exercise of compulsory purchase powers. We provide guidance on the statutory process and advise clients on all aspects of the claim, including the provision of valuations for land and buildings, and calculation of consequential losses arising from displacement.
In many cases, the land taken may possess a higher value for alternative use, which will be considered in the context of the total claim. Where appropriate, we advise claimants to apply for a Certificate of Appropriate Alternative Development (CAAD). If granted, this may provide a mechanism for realising the full value of the affected property. A recent case saw us negotiating compensation based on the value of land for retail warehousing, following success in securing an appropriate CAAD for a redundant industrial site.
Negotiated compensation settlements are achieved in the majority of cases, but in the event of dispute on matters of valuation or principle, cases can be referred to the Lands Tribunal for Scotland for determination. We are experienced in preparing cases and representing clients at Tribunal.
We also advise local authorities and developers who wish to promote compulsory purchase proceedings, providing reports identifying affected parties and estimates of compensation for inclusion in cost/budget appraisals.
